Norae, Inc., d/b/a Coverstar (and referred to here as Coverstar) provides these Law Enforcement Guidelines (“Guidelines”) to facilitate lawful requests from law enforcement and to ensure an efficient path for legal process. The Guidelines are provided for informational purposes and do not create or waive any legal rights. They are exclusively intended for use by law enforcement authorities. They are not intended for any other audience.
Legal Framework for User Data Disclosure
Coverstar stores, maintains, and processes user data as described in our Privacy Policy and Terms of Service. Coverstar will only disclose user data in a manner that is consistent with those terms and with applicable law.
Non-Emergency Requests
Where to Direct Non-Emergency Legal Requests for Disclosure
Law enforcement authorities may submit non-emergency requests for information by email to: lawenforcement@coverstar.app. The email submitting the request must include the legal process (or other valid documentation) that is the basis of the request. Coverstar will not respond to non-emergency requests from law enforcement through other, unofficial channels. The above-listed email address may not be used for requests from non-law enforcement or non-governmental entities.
Legal Framework for User-Data Disclosure to U.S. Law Enforcement Authorities
Coverstar will disclose user information to U.S. law enforcement in response to lawful requests under the Electronic Communications Privacy Act (“ECPA”) and other legal authorities. ECPA generally prohibits Coverstar from disclosing user data without legal process, such as a subpoena, court order, or search warrant, unless a statutory exception applies, such as the exception for emergency disclosures (discussed further below).
Requirements for Non-Emergency Legal Process
- It must be addressed to the appropriate Coverstar entity, i.e., Norae, Inc.
- It must be issued by an appropriate legal authority, including the authority’s name, the name of the individual issuing the legal process, and contact information for all relevant parties.
- It must be signed by an appropriate authority.
- It must cite the applicable act, law, or regulation that supports the legal process.
- It should include an indication of the type of offense(s) under investigation and its connection to Coverstar’s products or services.
- It must provide a valid and reasonable date and time to return any responsive materials.
- It must specifically identify the exact data fields being sought, appropriate for the type of legal process being issued.
- It must include sufficient information regarding the user(s) account, such as a username, email address, phone number, or other unique account identifier.
- It must indicate the specific time period for which information is requested.
In response to legal process:
- Subpoena: Coverstar may disclose basic subscriber information.
- Court Order: Coverstar may disclose other subscriber information, such as transactional data.
- Search Warrant: Coverstar may disclose user content, if any content exists.
Emergency Requests
Where to Direct Requests for Emergency Disclosures
Law enforcement authorities may submit emergency requests for information by email to: lawenforcement@coverstar.app. The email submitting the request must include a valid request for emergency disclosure and should have a subject line with the words “EMERGENCY DISCLOSURE” in capital letters.
Valid Requests for Emergency Disclosures
Coverstar may respond to requests for emergency disclosures if a valid emergency request provides sufficient information to form a good-faith belief that an emergency poses a threat of imminent harm or serious physical injury. Emergency disclosure requests must:
- Identify the person in danger of death or serious physical injury.
- Provide sufficient information to identify the user(s) whose data is necessary to prevent the emergency.
- Include a description of the nature of the emergency and the alleged harm or exigency.
- Specifically identify the data fields being requested and their relevance to the emergency.
- Certify that the request relates to an emergency requiring disclosure without delay.
- Certify that legal process cannot be obtained in time to address the emergency.
If the request concerns a California resident, the request must be approved by a high-ranking agency officer, and the requesting authority must agree to petition a court for an appropriate order within three days or destroy the information if the order is not granted.
Preservation Requests
Coverstar does not guarantee the existence or retention of particular user information. Upon receiving a preservation request, Coverstar will attempt to preserve available user data for up to 90 days or as required by law. If no formal legal process is received before the preservation period expires, the preserved information may be deleted.
Reimbursement
Coverstar reserves the right to seek reimbursement for the costs associated with responding to legal process requests.
